The Supreme Court Civil Procedure Rules, 2022 (‘CPR 2022’) come into effect on March 1, 2023. These rules will significantly change the procedural landscape of civil litigation practice in The Bahamas. Part 1 of the new rules provide for an “overriding objective”, namely, “to enable the Court to deal with cases justly and at proportionate cost.” The new regime is designed to enhance the administration of justice by dealing with cases before the court in a manner that is responsive, fair, just, cost-effective, expeditious and proportionate. This overriding objective may be said to the spirit of the reform occasioned by these rules.
